{"id":5396,"date":"2021-04-13T21:58:00","date_gmt":"2021-04-13T20:58:00","guid":{"rendered":"https:\/\/www.fairlabor.org\/?post_type=report&#038;p=5396"},"modified":"2024-12-19T17:46:08","modified_gmt":"2024-12-19T17:46:08","slug":"charter-link-clark-inc","status":"publish","type":"report","link":"https:\/\/www.fairlabor.org\/reports\/charter-link-clark-inc\/","title":{"rendered":"Charter Link Clark, Inc"},"content":{"rendered":"<div class=\"rich-text section\" data-dc-animate>\n    <div class=\" fade-animate \"  data-dc-animate-ref=\"fadeBlocks[]\">\n        \n\n<p>In October 2020, FLA member company lululemon athletica (lululemon) requested the FLA to undertake an independent investigation with respect to several allegations concerning freedom of association and collective bargaining rights at the Charter Link Clark, Inc. factory in the Clark Special Economic Zone, Pampanga, Philippines, a supplier to lululemon.<\/p>\n\n\n\n<p>The FLA agreed to conduct what is referred to as a brand-commissioned Safeguard investigation, one of its tools for addressing \u201cinstances of significant and persistent compliance\u201d with the FLA\u2019s Workplace Code of Conduct and Compliance Benchmarks in production facilities used by FLA member and affiliate companies. The FLA commissioned independent investigator Michael B. Ocampo to conduct the investigation. (While the investigation did not originate as a result of a Third Party Complaint (TPC) received from a union and\/or workers at the factory, it proceeded in the same manner as a TPC investigation.)<\/p>\n\n\n\n<p>The request for the independent investigation followed lululemon\u2019s active engagement with respect to the underlying issues at the factory through monitoring, dialogue with factory management, and other oversight dating back to 2019.&nbsp; These are summarized in the Overview section of the full report.<\/p>\n\n\n\n<p>The FLA appreciates the diligence and thoroughness with which Mr. Ocampo undertook his investigation, notwithstanding particular challenges posed by the ongoing COVID-19 pandemic.&nbsp;&nbsp;The FLA also recognizes the high degree of cooperation afforded both by factory management and union officials during the course of the investigation, as a result of which the investigator was able to obtain the information necessary for him to complete his investigation and report in a timely manner. &nbsp;This included visits to the factory, the conduct of interviews with workers and management officials, a detailed review of pertinent documents, and a substantial worker survey he prepared that is set out in Annexes A and B of the report.<\/p>\n\n\n\n<p>Among his important findings, the investigator verified that a range of serious issues raised concerning anti-union practices and alleged \u201cunion favoritism\u201d \u2013 as documented in his report \u2013 have been largely addressed, with lululemon playing an important role through its engagement with factory management and the parent company and its support for efforts to advance social dialogue and good faith collective bargaining. &nbsp;He also noted that while there were earlier delays in negotiations toward a collective bargaining agreement (CBA) that contributed to the serious issues between workers and factory management documented in the report, a CBA was signed with the CLIEU-FFW union on March 26, 2021, and ratified by a majority of factory workers roughly two weeks later.<\/p>\n\n\n\n<p>Beyond the investigator\u2019s careful analysis of the factory\u2019s responses to specific allegations of anti-union practices, verbal harassment and related mistreatment of workers, overtime procedures, the functioning of the Labor-Management Council, and additional areas of concern, his report underscores the central importance of a sustained social dialogue between management and the authorized union in promoting a healthy industrial relations structure.&nbsp; To that end, the report takes note of the recent developments with respect to the signing and ratification of the CBA and the importance of good faith negotiations moving forward \u2013 as well as the importance of finding a solution concerning the reinstatement of the two senior union officials, as discussed in both the Findings and Recommendations sections.<\/p>\n\n\n\n<p>The FLA notes the thorough nature of the report\u2019s coverage of the issues raised, and how the Findings section at pages 17-35 sets forth Mr. Ocampo\u2019s analysis of each issue and the extent to which it has been addressed.&nbsp;&nbsp;In setting out which issues have been resolved sufficiently and those for which improvements are still needed, he provides a foundation for the six specific sets of recommendations for corrective actions that follow at pages 36-39, as well as two additional recommendations now that the CBA has been signed and ratified.<\/p>\n\n\n\n<p>The FLA looks forward to continued communication with lululemon concerning its engagement with factory management on the implementation of these recommendations, which will be important to building on the progress to date and to fulfilling the objectives that prompted the request roughly six months ago to initiate this Safeguard investigation.<\/p>\n\n\n\n<h5 class=\"wp-block-heading has-mid-blue-color has-text-color\">May 2022 Update<\/h5>\n\n\n\n<p>In October 2021, lululemon requested FLA to undertake a follow up assessment of the situation at Charter Link. FLA agreed to conduct that assessment to verify the status of implementation of the corrective action plan items listed in the April 2021 Independent Investigation Report, specifically those pertaining to:<\/p>\n\n\n\n<p>a. Union-management relations and union interference issues<br>b. Status of labor cases involving CLIEU-FFW officials<br>c. Reorganization of the Labor Management Council<br>d. Implementation of the Collective Bargaining Agreement<br>e. Overtime work and workdays<br>f. Factory polices and disciplinary procedures<br>g. Interactions between workers and supervisors<\/p>\n\n\n\n<p>The same independent investigator, Michael B. Ocampo, undertook the new review and analysis, and his final \u201cReport on the Verification Process\u201d is attached below. As noted in the Introduction and Executive Summary of his report, the investigator found that \u201cmany of the important recommendations made in his April 2021 report had been implemented\u201d but at the same time noted that \u201cin view of the recurring and new issues identified during the verification process,\u201d it was also necessary to recommend additional corrective actions in the new report.&nbsp; As he noted, notwithstanding the improvements made since the original report and implementation of its recommendations, there were issues identified that unless corrected could threaten the gains made in union-management relations. <\/p>\n\n\n\n<p>FLA again thanks Mr. Ocampo for his diligence in undertaking a thorough and objective review and producing a set of significant new findings and recommendations.
